Terms & Conditions — Video Background Changer

1. Introduction

  1. These Terms & Conditions (“Terms”) govern your access to and use of Video Background Changer and related services, websites, APIs and mobile applications (collectively, the “Service”) provided by Code Knitters LLC (“Code Knitters”, “we”, “us”, “our”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Definitions

  • “User”, “you”, “your” — any person or entity using the Service.
  • “Content” — videos, images, audio, text or other files you upload.
  • “Processed Output” — resulting files returned to you after background removal/replacement.
  • “Payment Processor” — any third-party payment service we use to accept web payments (Merchant of Record or payment gateway). In-app purchases are handled by the relevant app marketplace (Apple App Store, Google Play) under their billing rules.

3. Eligibility & Accounts

  1. You must be legally capable of entering a binding contract and at least 18 years old (or the age of majority in your jurisdiction). Parents/guardians are responsible for minors using the Service under their account.
  2. You are responsible for keeping account credentials secure and for all activities that occur under your account. Notify support immediately of unauthorized use.

4. Acceptable Use & Prohibited Content — ZERO TOLERANCE

You retain ownership of Content you upload. You are solely responsible for ensuring you have all rights, consents and permissions to upload and process Content and to use any Processed Output.

The following categories and uses are strictly PROHIBITED. Violation will result in immediate suspension or permanent termination of your account, removal of content, refusal of refunds, reporting to law enforcement and/or rights holders, and may lead to criminal or civil liability:

A. Copyright Infringement & Pirated Content — PROHIBITED

  • Upscaling, enhancing, processing or otherwise manipulating copyrighted material without authorization from the copyright holder.
  • Processing stolen, pirated, or illegally distributed images, artwork, logos, or media.
  • Unauthorized enhancement or manipulation of brand logos, trademarks, or proprietary designs for commercial or deceptive use.
  • Processing watermarked stock images (including attempts to remove watermarks) or other licensed stock assets without the appropriate license.

Legal notice: Copyright violations may result in DMCA or equivalent takedown requests, account termination and legal action.

B. Adult & NSFW Content — PROHIBITED (Zero tolerance)

  • Any sexual content, nudity, pornography, sexual acts or explicit sexual imagery in uploaded or generated content.
  • Any sexualized or suggestive content involving persons under 18.
  • Suggestive or provocative material intended primarily for sexual arousal.
  • Adult-oriented erotica or NSFW artwork.

Enforcement: Adult content violations result in immediate and permanent account suspension with no warnings or appeals.

C. Illegal & Harmful Activities — PROHIBITED

  • Enhancement or alteration that facilitates fraud, identity theft, document forgery, or other criminal activity.
  • Content that depicts or promotes violence, gore, self-harm, or dangerous activities.
  • Harassment, bullying, threats, doxxing or targeted intimidation.
  • Hate speech or content promoting discrimination or violence against protected classes.

D. Unethical Uses & Deceptive Practices — PROHIBITED

  • Creation, facilitation, or distribution of deepfakes or manipulated media intended to deceive or harm.
  • Enhancing images to impersonate, misrepresent, or falsely attribute actions to individuals without explicit consent.
  • Processing images of individuals without their knowledge or consent where privacy invasion or harm could result.
  • Using processed content to mislead customers (e.g., falsely improving product images to misrepresent authenticity/quality).

We reserve the unfettered right to refuse to process, to remove, to disable access to, or to delete Content and Processed Outputs that violate these rules or any applicable law, and to cooperate with rights holders, payment providers and law enforcement.

5. User Warranties & Indemnity

  1. You represent and warrant that: (a) you own or are licensed to use the Content; (b) uploading or processing the Content does not violate any third-party rights or laws; (c) you will not use Processed Output to violate these Terms.
  2. You agree to indemnify, defend and hold harmless Code Knitters from and against all claims, damages, losses, liabilities and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your Content, or any breach of these Terms.

6. Service Operation, Storage & Ownership

  • Processing: We process the Content you upload to provide the Service and return Processed Output.
  • Temporary storage: Uploaded files are stored only as necessary for processing and for troubleshooting. By default we delete uploaded videos and temporary processing files from active servers within 24 hours after processing, unless retention is necessary for legal obligations, billing disputes, fraud investigations, or at your explicit request (see Privacy Policy).
  • Ownership: You retain ownership of your Content and Processed Outputs subject to third-party rights and licenses. By uploading you license us to store, copy and process the Content only to provide the Service.

7. Payments, Pricing & Payment Processors

  1. Web & other channels: Payments on our website are handled by third-party payment processors. The identity and terms of the payment processor will be visible at checkout where required. The payment processor’s terms govern payment processing, refunds and chargebacks for transactions it processes.
  2. In-app purchases: Purchases made in mobile apps use Apple/Google billing and are governed by the app store’s terms and refund rules.
  3. Pricing changes: We may change fees with notice; subscription renewals will be charged according to the plan you subscribed to.

8. Refunds & Chargebacks

  1. Refund handling: Refunds and chargebacks are managed by the payment processor or app store that processed the transaction. For web payments we generally adopt a 14-day refund practice where permitted by the payment processor and applicable law, but actual refunds depend on the payment processor’s policy and your payment method. In-app purchases require refunds via the app store.
  2. Refund refusals: Refunds will be refused where processing violated the Prohibited Content rules (Section 4), or when the payment processor’s rules or law prevent a refund. For example, transactions involving attempted or actual copyright infringement, adult content, deepfakes, fraud, or other prohibited uses are ineligible for refund.
  3. Chargebacks & recovery: If a chargeback is initiated, the payment processor or merchant bank will manage the dispute. If the chargeback is resolved against us, the processor may recover the refunded amount, fees and expenses from us; we reserve the right to seek recovery from the responsible account holder or user where permitted by law.

9. Advertising & Third-Party Services

  • Mobile apps may display ads from third-party ad networks. Advertisers and ad platforms operate under their own policies and privacy practices. We are not responsible for third-party content or practices.
  • We use third-party service providers (cloud hosting, analytics, communications, payment processors). See our Privacy Policy for details on processors and data sharing.

10. Suspension, Termination & Remedies

  1. We may suspend or terminate your account and access to the Service immediately for breaches of these Terms or suspected unlawful or abusive activity. Termination does not relieve you of obligations or liabilities incurred prior to termination.
  2. We reserve all available legal and equitable remedies, including pursuing damages, injunctions or criminal referrals.

11. DMCA & Copyright Complaints

If you are a copyright owner and believe content on the Service infringes your copyright, submit a notice to our designated agent at info@codeknitters.co. Include identification of the copyrighted work, location of infringing material, your contact details, a statement of good faith and a signature. We will respond consistent with applicable law, including removing or disabling access where required.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Disputes may also be subject to the payment processor’s or app store’s dispute rules where relevant.

14. Changes to Terms

We may modify these Terms. We will post the updated Terms with the last updated date; continued use after notices constitutes acceptance.
